We have seen stuff like this before but I think this is the first time that a big name company like motorola files against a console company for patent infringements. And it seems that Motorola has won this round but Microsoft still believes that they can win the commission review. If not then there is going to be a blockade of Xbox360's in the US.

First off dude, you need several sources on this. its not like we don't believe you its just needed in case no one is following this case.

Second, If worse comes to worse MS will just pay the back-payments and make an agreement with them. the 360 is too big for MS to lose to another company. but most likely they will win somehow...

UH OH! CHONGO!

Xbox 360's & Windows 7 is now banned in Germany thanks to a court injunction against Microsoft.

It sounds also like they knew they were going to lose the case as they've been frantically pulling out their production and distribution plants from Germany ahead of the rulling.

Naughty Microsoft.

Motorola has a hearing scheduled in U.S. on May 7th, though Judge may issue a later date

Regardless, a lot of aspects to software patents are bullshit.

Judge recommends X-box 360 ban in US


Following up on a previous ruling, which deemed Microsoft in violation of Motorola WiFi and video codec patents, judge David Shaw has recommended against the continued sale of the Xbox 360 in the United States, according to MCV. Should Microsoft be deemed in infringement of existing patents, it would threaten the possibility of selling consoles using that tech.

"Enforcing intellectual property rights outweighs any potential economic impact on video game console buyers," said Shaw.

This movement isn't a decision, but it could influence the International Trade Commission's final decision in the case. If the ITC happens to agree with Shaw's call, the verdict will move up to the White House, where the decision to halt sales will be at the whim of President Barack Obama and his advisers.

With the Xbox 360 and Windows 7 having been banned in Germany this month, it's not a far cry to say Microsoft's infringement on Motorola Mobility's intellectual property could affect the States.

Microsoft argued to Shaw that a United States ban would be unfair to consumers, who would have limited options. Shaw declared Nintendo and Sony could pick up the slack.

If the ITC commissioners agree with Shaw then the recommendation will be presented to none other than US President Barack Obama, who (along with a small army of advisors) will have the final say.

A Microsoft representative stated, "the full Commission will rule on this in August, and until that time, nothing will change."

I agree that the decision will be moot by the time the appeals are done, but I was under the impressions if the sales are banned they are still going to be banned even if there is appeals. Or am I wrong?
