One thing to note about the Autodesk case is that it had nothing to do with the software's EULA. The licencing/owning issue wasn't even what Autodesk was suing about, and they absolutely should have won this case. However, in a sign of wisdom quite typical of the 9th Curcuit, they decided it was, ignored the actual reason for the lawsuit and made EULAs officially legally binding specifically when it comes to the own/licence distinction. Basically, the court decision was so full of holes that if anyone challenges this somewhere down the line, it will be reversed. Hopefully.
